The Chief Judge of Osun State, Justice Oyebola Adepele-Ojo, has ordered the dissolution of a 17-year-old marriage between Iyanda Oluwaseun and her husband, Iyanda Ayodeji.
The petitioner, Oluwaseun, had approached the court seeking the termination of the marriage under Section 15(1) of the Marriage Causes Act, stating that the conduct of the respondent had become unbearable.
Through her counsel, D. D. Awoyemi, she filed a petition asking the court to apply the provisions of the Marriage Causes Act and formally end the union.
According to the court documents, the couple got married on September 22, 2009, at a marriage registry in Lagos, and the union produced three children.
Oluwaseun also requested custody of the children, explaining that the relationship had broken down since 2021 due to what she described as irresponsible behaviour by the respondent.
While delivering judgment, Justice Adepele-Ojo noted that counsel to the respondent had acknowledged that the marriage had irretrievably broken down.
Evidence presented before the court showed that both parties had been living separately for about three years before the case was filed.
The court further held that the petitioner’s allegation of verbal abuse was not successfully challenged by the respondent.
Based on the evidence presented, Justice Adepele-Ojo ruled that the marriage be dissolved and granted custody of the three children to the petitioner.
