FEDERAL HIGH COURT JUDGMENT ON CONTINUING PROFESSIONAL DEVELOPMENT (CPD) POINTS

The Federal High Court, sitting in Abuja, yesterday, 27 January 2026, delivered judgment in Suit No. FHC/CS/1238/2025: Victor Ozioma Nwadike v. NBA & 2 Ors, presided over by Hon. Justice Mohammed Umar

In its considered decision, the Court set aside and nullified the provisions of the RPC, 2023, and the Nigerian Bar Association MCPD Rules, 2025, to the extent that they purport to add to, alter, or vary the conditions governing a legal practitioner’s right of audience in Nigerian courts.

The Court affirmed that while professional regulation is essential to the integrity and development of the legal profession, such regulation must remain consistent with and subordinate to statutory authority.

I urge the Nigerian Bar Association, and all relevant institutions to respect, comply with, and give full effect to the judgment of the Court.
