A Federal High Court in Abuja, on Wednesday, shifted judgment in a suit seeking the removal of the National Chairman of the All Progressives Congress (APC), Abdullahi Ganduje, to September 23.
Justice Inyang Ekwo had on July 5 fixed today (September 18) to deliver judgment in the suit, after parties adopted their processes.
It was gathered that the court registrar had reached out to all parties, informing them of the change of date as the judgment was not ready.
In the suit marked FHC/ABJ/CS/599/2024, the plaintiff, North Central APC Forum, led by Saleh Zazzaga, queried the propriety of Ganduje’s appointment as the Chairman of the APC when he is not from the North Central geo-political zone.
The suit has Ganduje, the APC and the Independent National Electoral Commission (INEC) listed as 1st to 3rd defendants respectively.
The plaintiff is seeking an order of court restraining Ganduje from further parading himself as the chairman of the APC, and an order directing INEC not to recognise Ganduje as chairman of the party and disregard all actions taken by him as chairman of the party.
The suit was instituted on the grounds that Ganduje, not being from a state in the North Central geo-political zone, should not be chairman of the APC.
The group argued that the National Executive Committee (NEC) of the party appointing Ganduje, from Kano State in the North West geo-political zone to replace Sen. Abdullahi Adamu from Nasarawa State in the North Central geo-political zone, breached Article 31.5(1) of the APC constitution and ultra vires the powers of the NEC of the party.
