Sean “Diddy” Combs Could Be Released Early if Appeal Succeeds

Sean “Diddy” Combs is continuing his legal fight as his attorneys push for his immediate release from federal custody. Lawyers for the 56-year-old music mogul asked the 2nd U.S. Circuit Court of Appeals in Manhattan to overturn his conviction and allow him to go free while his case is reviewed.

Diddy is currently serving a 50-month sentence tied to two counts of transportation to engage in prostitution. The charges stem from allegations involving former girlfriend Cassie Ventura, identified in court filings as Casandra Ventura Fine, an anonymous woman referred to as Jane, and several sex workers.

In a new filing, Diddy’s legal team argued that the sentence was unfairly influenced by accusations the jury rejected. “The judge defied the jury’s verdict,” the lawyers wrote, claiming the court relied on conduct tied to charges for which the disgraced music mogul was acquitted. They also noted that similar cases often result in far shorter sentences, typically under 15 months.

Judge Arun Subramanian previously denied bail, stating, “It is impossible for the defendant to demonstrate by clear and convincing evidence that he poses no danger.” Prosecutors agreed with Maurene Comey saying, “There is serious, serious conduct here.”

If the appeal fails, Combs is scheduled for release in May 2028.
