A former National Legal Adviser of the Peoples Democratic Party (PDP), Mark Jacob, has accused Samuel Anyanwu of destroying the party.

Jacob said Anyanwu and his supporters knew it was against the party’s constitution to contest for gubernatorial position and still hold on to the position of national secretary.

Naijaonpoint reported that embattled Anyanwu returned to the Wadata headquarters of the PDP and reclaimed the seat.

In an interview with Arise News on Monday, the PDP Chieftain stated that Anyanwu and his supporters planned to ridicule the main opposition party. He said the party is in trouble.

Let me say first of all that our party is in trouble, not because there is any serious attack from outside, but because individuals are fighting local battles, ignoring the bigger battle, and are wasting the energy, the goodwill of the party, the goodwill and the confidence of Nigerians, wasting it away on individual platforms.

“For me, Anyanwu is a big joker. He should stop this thing he’s doing because everybody that is a member of the party knows the position of the constitution. You cannot hold two positions at the same time. You cannot be national secretary and then go and be a gubernatorial candidate of the party. You cannot do it. That is sacrosanct, that is settled. He knows it and all the people around him or supporting him are aware of that position. So what he’s doing is an embarrassment not just to himself, but to all of us that are members of the party,” he said.

Anyanwu Cannot Disobey Appeal Court Ruling

The former Commissioner for Justice and Attorney General of Kaduna State said it was wrong for the 2023 PDP governorship candidate in Imo State to appeal a court ruling concerning his claim to the position of national secretary.

He advised him to obey the court’s ruling and avoid being misled by his supporters.

And when you are talking about high court orders, giving you power to remain secretary, you can’t be talking like that when there is a Court of Appeal decision. That is elementary. Anybody who knows this law knows that you cannot talk about High Court when there is a Court of Appeal decision, not just an interlocutory decision, the judgment of the Court of Appeal. You can’t toy with it. You can’t begin to talk of that you have appealed.

“Of course you are free to appeal, but everybody who is also a lawyer knows that declaratory judgments cannot be stayed. You can’t stay the judgment of the Court of Appeal that had made declarations that are specific. And if he doesn’t know, his lawyers know. Maybe they are refusing to tell him, but you can’t stay the decision of the Court of Appeal which is declaratory. The decisions of the Supreme Court on this matter are very clear.

“So I don’t know what he is talking about when he says that he has appealed. If you have accepted the position of the Court of Appeal, you ought not to be engaging in this kind of brigandage. You walk in, you begin to assume that you are bigger than the courts, and you are depending on the same courts to give you office. That is strange,” he stated.

Except for Atiku and Peter Obi, Tinubu has no Opposition

Jacob, who was appointed PDP National Legal Adviser in 2007, said except for the former presidential candidates of the PDP and Labour Party, Atiku Abubakar and Peter Obi, respectively; the All Progressives Congress (APC) government led by President Bola Tinubu would have no opposition.

According to him, citizens remain at the receiving end of PDP’s destruction by Anyanwu and his supporters.

“So for me, Anyanwu and his followers know exactly what they are doing. They are just destabilizing the party, making sure that the party doesn’t get anything, doesn’t survive the current problems we have. And Nigeria is being cheated.

“We don’t have a parallel opposition to the ruling government. So the government in power is free to do whatever it wants. There is no opposition to the government. Every policy of government goes unchallenged, except for a few voices from the former presidential candidates of the PDP and Labour Party. So this is sad that the PDP is not playing its role and cannot play its role. Because Anyanwu and co are happy to weaken the party,” he added.
