The Supreme Court has struck out the suit filed by the Osun State Government challenging the alleged withholding of local government funds by the Attorney General of the Federation.
The apex court delivered its lead judgment on Friday, ruling that the Osun State Attorney General had no legal standing to initiate the case.
The court held that local governments, as independent entities under the law, have the constitutional right to sue and be sued on matters affecting them.
It further stated that any challenge regarding the release of local government funds must be filed directly by the councils involved, not the state government.
With this position, the Supreme Court dismissed the suit and formally struck it out.
