Counsel Undertakes To Produce Ex-AMCON MD In Court, Seeks Suspension Of Bench Warrant

Shasore also appealed for the suspension of the bench warrant issued against Kuru.

The development comes after the EFCC filed six-count criminal charges against several individuals and organizations, including Kuru and Union Bank of Nigeria Plc, alleging their involvement in the mismanagement of funds belonging to Arik Air Limited, totaling N125 billion.

During the arraignment proceedings on Tuesday, December 3, at the Ikeja Judicial Division of the Lagos State High Court, Kuru was absent, prompting the trial judge to issue a bench warrant against him. In response, Shasore, through his law firm, Africa Law Practice NG & Company, wrote to the EFCC Chairman, Mr. Ola Olukayode, explaining the reasons for his client’s absence and undertaking to ensure Kuru’s presence in court on the next adjourned date.

In the letter, Shasore stated that neither he nor his client had received notice of the scheduled date and that Kuru had not been served with the Information/Charge. He further explained that upon learning of the arraignment, they promptly appeared in court to clarify their initial absence and the lack of notice.

Shasore’s letter, copied to the EFCC Prosecution Counsel, Wahab Shittu, SAN, unequivocally undertook to produce Kuru in court on the next adjourned date and respectfully requested the suspension of the execution of the bench warrant.

The court noted that the enforcement of the bench warrant rests with the prosecution and could be suspended based on the counsel’s undertaking. The outcome of Shasore’s appeal to the EFCC Chairman regarding the suspension of the bench warrant remains to be seen as the case continues to unfold.
