A Federal Capital Territory High Court in Abuja has upheld the continued detention of former Attorney-General of the Federation and Minister of Justice, Abubakar Malami (SAN), by the Economic and Financial Crimes Commission.
Justice Babangida Hassan today dismissed an application seeking Malami’s release on bail, in which he challenged the legality of his detention by the anti-graft agency.
The ruling, delivered on December 18, 2025, was confirmed in a statement issued by the EFCC spokesperson, Dele Oyewale.
Malami, through his counsel, Suliaman Hassan (SAN), had argued that his detention amid an ongoing investigation was unlawful and asked the court to grant him bail.
EFCC counsel, J. S. Okutepa (SAN), however, countered that the former minister was being held based on a valid remand order issued by the FCT High Court and granted by Justice S. C. Oriji.
In his judgment, Justice Hassan cited Section 35 of the 1999 Constitution (as amended) and provisions of the Administration of Criminal Justice Act, affirming that detention pursuant to a court-issued remand order is lawful.
He added that granting the application would amount to the court sitting on appeal over the decision of a court of coordinate jurisdiction, which it lacked the power to do.
Malami has remained in custody since December 8 after failing to meet the bail conditions set by the EFCC. He is reportedly under investigation for 18 alleged offences, including abuse of office and terrorism financing.
The anti-graft agency has also confirmed searches of his residences and offices in Abuja and Kebbi State, while Malami has accused the EFCC of bias in handling the case.
