A legal practitioner cum political analyst, Frank Tietie, has said the president lacks the power to revoke a pardon once it is granted.
Naijaonpoint reports that the presidency on Wednesday released a fresh list of inmates whose earlier granted presidential clemency has been revoked.
The list released by the Special Adviser to President Bola Tinubu, Bayo Onanuga, disclosed that 140 inmates were affected.
Tinubu also commuted Maryam Sanda’s death sentence for killing her husband in 2020, Bilyaminu Bello, to 12 years’ imprisonment.
Reacting to the development, Tietie, in an interview on Arise Television on Wednesday, stated that the president is not the judiciary and cannot exercise its power.
He said, “If we had a listening president in power, he would have reversed the fuel subsidy removal and increase in tariff.
“At the time the president first signed the first list, it was a complete act that he does not have the power to reverse. It was already accepted.
“The president does not have the power to convict anybody. As of the time he completed the pardon of these persons, they were all free.
“The president is not the judiciary. He cannot exercise judicial powers by saying you are no longer fit for pardon. It is not within his constitutional power.”
