Jay-Z is trying to have his name removed from the lawsuit against Sean “Diddy” Combs, alleging the music mogul sexually assaulted a 13-year-old.
After the lawsuit was filed, Jay-Z immediately released a statement denying the allegations and said he would fight his accuser in court.
Now, his attorney wants the lawsuit against him thrown out.
Jane Doe’s lawsuit against Jay-Z was made under the Victims of Gender-Motivated Violence Protection Act.
“Plaintiff cannot recover for her sole claim under the Victims of Gender-Motivated Violence Protection Act (the GMV Law), as a matter of law, because the statute does not have retroactive effect,” Alex Spiro wrote.
“Plaintiff asserts a violation of the GMV Law for conduct that purportedly occurred in September 2000. But the GMV Law was not enacted until December 19, 2000, three months after the FAC claims the conduct occurred, and cannot apply retroactively to create a cause of action unavailable to Plaintiff at the time in question.”
Spiro also had an issue with the venue where Jane Doe says the incident took place. Jane Doe says she attended the VMAs at Radio City Music Hall and that the alleged sexual assault occurred at a “large white residence with a gated U-shaped driveway.”
Spiro says “any such residence- to the extent it existed at the time would have been located outside the territorial boundaries of New York City,” and that the statute of limitations blocked the Plaintiff’s power to file the suit as the alleged incident would have taken place two decades ago.
