A judge has denied a second attempt from Sean “Diddy” Combs’ attempt at a mistrial after they alleged “prosecutorial misconduct” in a letter to U.S. District Judge Arun Subramanian.
The request for a mistrial hinged on testimony that the disgraced music mogul allegedly hung a witness from a balcony years back.
“The government has presented testimony that it knew or should have known was materially false related to its allegation that Mr. Combs dangled Bryana Bongolan from the balcony of Casandra “Cassie” Ventura’s apartment in September 2016,” Diddy’s attorneys wrote in their letter.
They claim the incident did not happen.
“This is not fodder for a mistrial,” the judge ruled. “This is the adversarial process at work,” adding that there “was absolutely no testimony from NAIJAONPOINT that was prejudicial in any way shape or form.”
Diddy’s trial is expected to continue for another week. He faces several federal charges, including racketeering conspiracy, sex trafficking, and transportation to engage in prostitution, and has pleaded not guilty to all charges.
