Will Smith is facing explosive new allegations from a musician who says his time on the star’s tour ended in harassment and an unjust firing.
Brian King Joseph, a professional violinist and former America’s Got Talent finalist, filed a lawsuit on Dec. 30 in Los Angeles Superior Court, accusing Smith and Treyball Studios Management, Inc. of sexual harassment and wrongful termination.
In the complaint, Joseph claims Smith “was deliberately grooming and priming” him after inviting him to join the actor’s Based on a True Story: 2025 world tour.
According to the filing, the situation escalated in March 2025 while the tour was in Las Vegas. Joseph alleges he returned to his hotel room to find clear signs someone had entered without force. Among the items he says were left behind were “wipes, a beer bottle, a red backpack,” an earring and hospital paperwork, as well as a handwritten note that read, “Brian, I’ll be back… just us,” signed “Stone F” with a heart drawn on it.
Joseph claims he was fearful “that an unknown individual would soon return to his room to engage in sexual acts” with him.
After reporting the incident to hotel staff, police and tour management, the lawsuit alleges the response was heavy handed. A tour manager allegedly “shamed” Joseph and informed him he was fired, with another violinist brought in to replace him.
The lawsuit says Joseph suffered “severe emotional distress,” financial loss and “PTSD and other mental illness” following the termination.
