NBA Accuses Rivers Administrator, Ibas Of Constitutional Violations

The Nigerian Bar Association (NBA), Port Harcourt Branch, has criticised the actions of the Sole Administrator of Rivers State, Vice Admiral Ibokette Ibas (rtd), accusing him of violating the Constitution and undermining democratic governance.

In a scathing press release issued by the Body of Chairmen Rivers State, and signed by the 8 Branch Chairmen, the NBA expressed deep concern over the recent developments in Rivers State following the declaration of a state of emergency, which led to the appointment of Ibas as the Sole Administrator.

The NBA decried the continued interference with constitutionally guaranteed structures, including the suspension of elected state officials and recent appointments made by Ibas.

The lawyers’ body described these actions as unlawful, provocative, and damaging to democratic institutions.

“The Nigerian Bar Association, Port Harcourt Branch, unequivocally condemns the actions of the Sole Administrator, which, in our view, violate the spirit and letters of the Constitution of the Federal Republic of Nigeria, 1999 (as amended),” the statement read.

The association emphasised that, as a body committed to upholding the rule of law, it cannot remain silent in the face of such constitutional violations.

The NBA warned that such actions pose a serious threat to Nigeria’s democratic experiment and may lead to a loss of public trust in both governance and the legal system.

The NBA also drew attention to the alleged harassment and intimidation of citizens, particularly those who have criticised the state of emergency or attempted to protest peacefully.

The Bar Association expressed concern that this could further alienate the people of Rivers State and erode their confidence in the state’s governance.

In a direct appeal to President Bola Tinubu, the NBA called for an immediate review and reversal of the emergency governance framework in Rivers State.

The body also demanded the reinstatement of Governor Siminalayi Fubara and other duly elected officials, stressing that the people’s mandate should not be discarded.

“We remind the Federal Government and all relevant institutions that the democratic will of the people is sacrosanct and must be respected,” the statement emphasized.

The NBA concluded by reiterating its unwavering commitment to democratic values, constitutionalism, and the peaceful resolution of conflicts.

The association warned that normalizing administrative actions that undermine the constitution could set a dangerous precedent for governance across Nigeria.
