Nick Carter is asking a judge to dismiss sexual assault claims filed against him, arguing that he was thousands of miles away from his accuser on one of the dates she alleges an assault took place.
Carter filed new court documents on Jan. 7, seeking to have Ashley Repp’s lawsuit thrown out.
Repp sued Carter in 2023, claiming she was sexually assaulted three times in 2003 when she was 15. In her lawsuit, she acknowledged the dates were estimates. However, Carter’s legal team says Repp consistently identified Oct. 27, 2003, as the date of one alleged assault on a yacht in Florida. According to Carter, that could not have happened.
“On October 27, 2003, Carter was over 2,500 miles away,” his attorney said, stating the singer was attending the 2003 Radio Music Awards in Las Vegas. Carter’s team says he was photographed at the event and presented that evidence during Repp’s deposition. When questioned, Repp admitted it was possible the date was incorrect, while maintaining that an assault occurred.

Carter, 45, has repeatedly denied all allegations. His attorneys also claim Repp previously told law enforcement the encounters were consensual and that she had misrepresented her age. He further alleges Repp is working alongside his other accusers, Shannon Ruth and Melissa Schuman, to pressure him into a financial settlement.
Carter is now asking the court to dismiss all claims, including sexual battery and emotional distress, saying the accusations are false and unsupported.
