Prosecutors allege that Kay Flock wasn’t just rapping about gang life — he was orchestrating it. They say he used his platform to push younger boys deeper into violence, ignite new beefs, and turn drill culture into a street war recruitment tool.
In their words, Kay Flock “goaded others into becoming shooters” and helped turn casual neighborhood tensions into life-or-death conflicts.
THE MURDER ACQUITTAL DIDN’T SAVE HIM
While jurors cleared Kay Flock of murder in the 2021 killing of Hwascar Hernandez, prosecutors insist the acquittal doesn’t wipe away responsibility. They argue he still “went to enemy territory looking for trouble” and sparked deadly retaliation cycles.
The memo outlines a series of violent episodes tied to him, including a 2020 shooting that wounded four people and another in 2021 where an 18-year-old woman was shot in the face.
FAME ONLY “POURED GASOLINE ON THE FIRE”
By 2021, Kay Flock’s career was exploding. He signed with Capitol Records and watched his track “Is Ya Ready” climb past 100 million views.
But prosecutors say the fame didn’t calm things down — it poured fuel on the fire. They argue his music and videos glamorized real-life killings, taunted dead teenagers, and drew thousands of young fans into the gang lifestyle he represented.
THE FEDS SAY HE SHOWED ZERO REMORSE IN JAIL
Even after being convicted, prosecutors say Kay Flock demonstrated “a complete disregard for the law.” They cite jailhouse messages where he allegedly instructed someone to post on Instagram: “I beat the top count I made the judge cry… Kill all rats!!!!”
To prosecutors, that message alone proves he’s unrepentant and still influencing violence from behind bars.

The government’s recommended sentence matches the Probation Office’s calculations:
20 years for racketeering.
20 years for assault.
10 years mandatory for the gun charge.
